Chapter 7 Bankruptcy

A Chapter 7 bankruptcy is filed for the purpose of liquidating debt. This bankruptcy will also stop creditors from suing and collecting any of your debts. The need to file a Chapter 7 bankruptcy is normally caused by a job lay-off, divorce, business loss, sickness or over extension of debt creating payments of more than can be paid by the consumer. Once the Federal Bankruptcy Court has approved the Chapter 7 bankruptcy the Petitioner who has filed the debtor relief will receive a discharge for debts withou paying them. Under normal circumstances the Petitioner may keep their home, car, furniture and some personal possessions as long as these assets meet the exemptions allowed under the Chapter 7 guidelines. The Petitioner must get a Pre-Counseling Certificate before filing the bankruptcy peitition and obtain a personal financial management class before receiving a discharge from the bankruptcy Court.

Chapter 13 Bankruptcy

A Chapter 13 bankrupcty is a different type of bankruptcy. It does not eliminate your debts completely but provides a way these debts may be paid over certain time period approved by the Federal Bankruptcy Court. A court approved plan is normally approved from 3 to 5 years to pay off the personal debts of the petitioner. Not all creditors in this type of bankruptcy get paid in full. The dets that are left unpaid will be discharged at the end of the payment plan and are discharged.
